No, Paul, they are the same, you can get your money back or get a new vehicle.

Christina Gill Roseman -  The Lemon Law only applies to new vehicles, but a federal law, the Magnuson Moss Warranty Act, can get you money if you have problems that are not repaired under warranty for your used vehicle.

What about the rule that a vehicle must have the problem three times before qualifying as a lemon. What if it's a serious safety issue?

MY VEHICLE IS A YEAR OLD, I GOT A GREAT DEAL AND A NICE WARRENTY...BUT MY CAR PULLS TO THE RIGHT ITS BEEN BACK FIRST TIME THEY SAIF THEY FIXED IT THE SECOND TIME THEY SAID THE MANAGER DROVE IT AND IT IS OK BUT... Under the Lemon Law, your vehicle must have a problem that substantially impairs use, safety or value and that problem is not repaired in a reasonable number of attempts.   Three attempts is the best way to show it was not repaired in a reasonable number of attempts, but if the problem is serious enough, your car can be a lemon with less than three repairs.

What is the statute of limitations for bringing a lemon law suit? I have a car that is 5 years old but I've had problems for pretty much the whole time. Would the statute start to run when they try to fix the same problem for the third time or when you buy the car?

Kellie--The statute of limitations is usually four years for breach of warranty claims.

I dont suppose that if you buy a used vehicle and three different things go wrong in less than a month any laws would apply

Your vehicle would not be a lemon, but if it was under warranty, you might be able to recover money under the Magnuson Moss Warranty Act.

I would suggest taking the vehicle to a different dealer.   If it is under the manufacturer's warranty, you can take it to any dealer for that manufacturer, and don't have to just go to the selling dealership.

But when does the four years start to run? At the time of purchase or once the warranty is "breached" by them trying over and over and over to fix the problem and they just never do?

Christina Gill Roseman -  Damages under the Magnuson Moss Warranty Act are usually diminution in value of the vehicle because of the problems, typically 10 to 30 percent of the purchase price.

That is a good question.   It would depend on the specific problems and when you found out about them.   You might not  have a lemon claim if the problems have been going on for more than four years but I think you still might have a claim for damages under the Magnuson Moss Warranty Act.
